Written against the actual product, not a template. Where this language doesn't legally hold in your jurisdiction, the underlying Nepali law does.

§01The service

“Lekaly” is a mobile application and a website at lekaly.com operated by Lekaly Pvt. Ltd., a company registered in Nepal under CIN 2024-KTM-118472.

The service includes:

  • A reference catalog of treks, waypoints, permits, and operational notes for Nepal.
  • An offline-first mobile app with a trek planner, AMS checker, and saved-plan storage on your device.
  • An optional account that lets you submit quote requests and post moderated reviews.
  • A pilot panel of TAAN-licensed agencies that can receive your quote requests.
  • A marketing site, a public blog (“Field notes”), and an agency-application form.

By installing the app, opening lekaly.com, submitting a quote request, or creating an account, you agree to these terms.

§02Eligibility & accounts

Age. You must be at least 16 years oldto create an account. Trekking at altitude carries real risk, the quote flow forms a commercial relationship with an agency, and the privacy framework we work to (GDPR) treats under-16s differently. If you’re younger than 16, ask a parent or guardian to hold the account on your behalf — they take on all responsibilities under these terms.

Account is required. Every screen of the Lekaly mobile app — the catalog, permit table, waypoint cards, AMS checker, offline maps, quote flow, reviews — lives behind sign-in. There is currently no guest mode.

You can register one of three equivalent ways: email + password, Sign in with Apple, or Sign in with Google. Whichever you pick, the same account opens up; you can switch methods later for the same email. We do not request elevated Google or Apple scopes — neither service sees anything about your usage of Lekaly after the sign-in handshake.

You are responsible for keeping your account credentials confidential and your social-provider session secure. Tell us at [email protected] if you believe your account has been accessed by someone else.

Account fields like emergency contact, insurance reference, medical note, and the last four characters of your passport number are all optional. They exist to pre-fill the quote and permit screens for you — you can leave them blank and everything still works.

§03Safety disclaimer

READ THIS

Lekaly is a planning and reference tool. It is not a substitute for a licensed guide, a doctor, a current weather forecast, or your own judgement. Trekking at altitude carries risks of acute mountain sickness, frostbite, cold injury, river crossing accidents, and avalanches. Weather changes in an hour. The AMS checker computes a score from what you typed in — it does not diagnose.

You walk at your own risk. By using the app you accept that Lekaly Pvt. Ltd., its team, and any agencies on the pilot panel cannot be held liable for outcomes that follow from your trek. If in doubt at altitude, descend. HRA Manang: +977 980-123-0114.

§04Acceptable use

You agree to use Lekaly for personal trip planning, reference, and (if you opt in) for sending quote requests to the agency panel. You may not:

  • Scrape, bulk-export, redistribute, or republish our trek catalog, permit data, waypoint contacts, or blog content without our written permission.
  • Modify, reverse engineer, or attempt to derive the source of the app or API.
  • Misrepresent yourself in the quote flow (false trek dates, false party size, false contact details).
  • Submit reviews you did not write, paid reviews, or reviews about treks you did not personally walk.
  • Contact a waypoint phone number for purposes other than the trekking-related reason it is published for (lodging enquiry, AMS aid, transport booking).
  • Use the service to send unsolicited commercial messages, to scrape other users, or to probe our infrastructure.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on a device you own or control, for non-commercial purposes, as long as you abide by these terms.

§05Quote requests & the agency pilot

The quote flow is an opt-in feature for trekkers and a 2026 pilot for agencies on our panel. When you submit a quote request:

  • We store the structured request (trek, dates, party size, services, budget band, preferences, reply-to email) in our database.
  • Our Kathmandu ops team manually reviews each request and forwards it to two or three TAAN-licensed agencies on the pilot panel. Forwarding is not automatic.
  • Each matched agency may reply with a single, time-bounded quote. You see the quotes in the app and can accept one, ask follow-up questions, or do nothing.
  • If you accept a quote, you are contracting directly with that agency. Lekaly is not a party to that agreement, does not collect payment from you, and does not hold funds in escrow.
  • During the 2026 pilot we do not charge agencies a per-lead fee and do not take a commission from you. Any future pricing model will be published at least 90 days before it applies.

Disputes about an accepted quote (cancellations, refunds, on-trail service quality, insurance claims) are between you and the agency. We can help with mediation in good faith but we are not the contracting counterparty.

Agencies that apply to the pilot panel agree separately to a panel agreement that covers TAAN licence verification, response-time expectations, and removal grounds. Applying via the for-agencies form does not constitute admission to the panel.

§06Reviews & user-generated content

When you post a trek review, you keep ownership of the words you wrote and grant Lekaly Pvt. Ltd. a worldwide, royalty-free, perpetual licence to display, edit for length or clarity, and translate that review on lekaly.com, in the app, and in related editorial material.

Every review goes into a moderation queue before it appears publicly. We may decline to publish, edit, redact, or remove a review at any time — including after publication — if it:

  • Contains personal data about third parties without their consent.
  • Names a specific guide or agency in a way our ops team cannot verify.
  • Promotes a competing service or contains a referral / affiliate link.
  • Is hateful, defamatory, threatening, or obviously fabricated.
  • Doesn’t actually relate to a trek you walked.

§07Information accuracy

We work hard to keep permit fees, waypoint contacts, AMS guidance, and trail data current — our ops team walks each supported trek at least four times a year. Even so, the information in the app is presented “as is” and may be out of date for reasons outside our control: a permit counter changes its fee schedule overnight, a lodge changes hands, a phone number is disconnected without notice.

You should verify safety-critical information (permit hours, current river crossings, flight cancellations, evacuation procedures) at the counter or with HRA before relying on it.

§08Intellectual property

The Lekaly name, logo, brand, copy, design, illustrations, and code are owned by Lekaly Pvt. Ltd. The app and the site contain open-source components used under their respective licences; nothing in these terms restricts your rights under those licences.

Waypoint contacts (phone numbers, lodge names, addresses) are factual information collected and verified by our ops team. You may reference them with attribution to Lekaly; you may not bulk-export, re-host, or include them in a competing product.

§09Third-party services

Lekaly relies on a short list of third parties spelled out in our privacy policy — MongoDB Atlas for the database, Cloudflare for the edge, Amazon S3 for file uploads, an SMTP relay for transactional email, Apple and Google for Sign in with Apple / Sign in with Google, the Expo Push Service (using APNs and FCM) for any notifications you opted into, and the App Store / Play Store for distribution. Your use of those underlying services is governed by their own terms.

We do not currently use a payments provider, an advertising network, a third-party analytics SDK, or a crash-reporting service.

§10Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied — including merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, secure, accurate, or error-free.

No advice or information, oral or written, obtained from Lekaly or through the service creates any warranty not expressly stated in these terms.

§11Limitation of liability

To the maximum extent permitted by law, Lekaly Pvt. Ltd. and its team are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, the site, or the quote flow — including but not limited to altitude-related illness, frostbite, missed flights, weather-related delays, equipment failure, lodging quality, theft on the trail, or disputes with agencies introduced via the quote flow.

If a court finds that the disclaimer in §03 or the limitations in this section are unenforceable in your jurisdiction, our maximum aggregate liability is the total amount you have paid Lekaly Pvt. Ltd. in the prior twelve months — which, for the avoidance of doubt, is currently NPR 0 for individual trekkers, since the app and the quote pilot are free to use.

§12Indemnity

You agree to indemnify and hold Lekaly Pvt. Ltd. and its team harmless from any claim, demand, or liability — including reasonable legal fees — arising from your breach of these terms, your misuse of the service, your content (including reviews), or your interactions with a third party introduced via the quote flow.

§13Termination

You can stop using Lekaly at any time. Settings → Delete account in the app removes your user record, profile, and push token immediately, anonymises your quote requests, and detaches your reviews from your identity — see privacy §12for the full cascade. You’ll receive a confirmation email at the account address.

If you’d rather we hard-delete a specific quote thread or review (instead of the default anonymisation), email [email protected] and we’ll handle it within 14 working days.

We may suspend or terminate access — with or without notice — for any user who violates these terms, attempts to scrape the API, runs fraudulent quote requests, posts manipulative reviews, or otherwise harms the service or the panel. Where we have a contact for you we’ll attempt to email a heads-up first.

§14Governing law and disputes

These terms are governed by the law of Nepal. Any dispute arising from these terms is subject to the exclusive jurisdiction of the Kathmandu District Court. We prefer a written exchange first — write to [email protected] and we’ll engage within 10 working days.

§15Changes to these terms

We may update these terms — to reflect a new feature, a change in third-party services, or a legal requirement. Material changes are announced as a Field Note at least 30 days before they take effect; editorial fixes go in without notice. The “Effective” date at the top of this page changes either way.

Continuing to use the service after an update means you accept the new terms. If you don’t, you can stop using it as described in §13.
